Acceptable Use Policy

This Acceptable Use Policy (“AUP”) outlines the acceptable behavior and prohibitions for using the Knowledge Catalyst Platform across its ecosystems, including Cross-Border Trade Finance, Sustainability, Health & Insurance, and Talent Ecosystems. This policy applies to B2G, B2B, B2B2C, individual users, and those with public access to the platform. By using the platform, you agree to comply with this AUP, the Terms of Use, and the Privacy Policy.

1. General Prohibitions

You agree not to misuse the platform or assist others in doing so, including but not limited to:

1.1 Illegal Activities

  • You may not use the platform for illegal or prohibited activities, including but not limited to fraud, money laundering, terrorism, or any activities that violate trade, healthcare, environmental, financial, or other international laws relevant to the ecosystems.
  • Use of the platform in violation of any applicable law, regulation, or court order is strictly prohibited.

1.2 Harm to Others

  • You may not harass, harm, or infringe upon the rights of others. This includes threatening, defaming, bullying, or invading the privacy of other users, businesses, governments, or healthcare entities using the platform.

1.3 Harm to the Platform

  • Attempting to disrupt or undermine the performance, security, or availability of the platform, including launching Denial-of-Service (DoS) attacks, introducing malware, or tampering with data, is prohibited.
  • Misuse of the platform for the unauthorized interception of data, hacking, or exploitation of vulnerabilities is forbidden.

1.4 Infringement of Intellectual Property

  • You may not upload, distribute, or make available any content that infringes upon the intellectual property rights of others, including but not limited to copyrights, trademarks, and patents related to trade documents, health records, or sustainability certifications.

2. Data Protection and Privacy

2.1 Compliance with GDPR, PDPA, and International Data Privacy Laws

  • All users must comply with relevant data protection regulations, including the General Data Protection Regulation (GDPR), Singapore’s Personal Data Protection Act (PDPA), and other applicable privacy laws. This applies particularly to personal data processed in the Cross-Border Trade Finance, Health & Insurance, Sustainability, and Talent Ecosystems.
  • Users are responsible for ensuring that any personal data (such as financial, health, or credential data) processed on the platform is done in accordance with these laws.

2.2 Handling Personal Data

  • You are only permitted to process personal data for legitimate and lawful purposes as set forth in our Privacy Policy. Unauthorized collection, use, or sharing of personal data, particularly sensitive data like health or financial information, is strictly prohibited.
  • You must ensure that any data processed through the platform is accurate and current. Misuse of personal data can result in account suspension or legal action.

3. Public Access and Contributions

3.1 Public Data Use

  • Data available through public areas of the platform, including trade certifications, sustainability reports, or credentials, is subject to the Terms of Use and must not be misused, scraped, or harvested for unauthorized commercial purposes.

3.2 Contributions to Public Areas

  • If you contribute to public forums, repositories, or knowledge-sharing areas within the platform, you are responsible for ensuring that your contributions comply with all applicable intellectual property, privacy, and data protection laws.
  • You must ensure that any public contributions are accurate and do not mislead or harm other users.

4. Platform Security

4.1 No Unauthorized Access

  • You are prohibited from attempting to access any systems, networks, or data that you do not have permission to access, particularly in sensitive areas like trade finance, healthcare, or sustainability. This includes “hacking,” bypassing security measures, or using tools to exploit vulnerabilities.

4.2 Respect Access Controls

  • You must respect all access controls and security settings, particularly regarding sensitive information related to B2G, B2B, and B2B2C Misuse of credentials, impersonation, or unauthorized access to accounts is forbidden.

4.3 No Interference

  • You may not interfere with, disrupt, or damage the platform’s functionality by introducing viruses, malware, or using automated systems to disrupt normal operations. Any attempt to compromise the security of our platform is strictly prohibited and will result in immediate action.

5. Communication and Content Sharing

5.1 No Spam or Deceptive Communications

  • The platform may not be used to send unsolicited emails, promotions, advertisements, or spam, especially when it involves users in regulated ecosystems like healthcare or trade finance. Misrepresentation or deceptive communication is also prohibited.

5.2 Accuracy of Shared Content

  • Users must ensure that the information and content shared on the platform, including health records, trade documents, or sustainability data, are accurate, truthful, and do not infringe upon the rights of others.
  • Deliberately falsifying or misrepresenting data, particularly within the Cross-Border Trade, Health, and Sustainability sectors, is strictly prohibited.

6. Intellectual Property and Licensing

6.1 User-Generated Content

  • By uploading or contributing content to the platform, such as sustainability certifications, trade finance records, or digital credentials, you affirm that you have the necessary rights and permissions to share this content. You grant Knowledge Catalyst a limited, non-exclusive license to use this content as necessary for the platform’s functionality.

6.2 Prohibited Use of Intellectual Property

  • You may not copy, modify, distribute, or use any part of the platform’s content, including software, trademarks, or proprietary information, without proper authorization.

7. Misuse and Consequences

7.1 Violation of AUP

  • If you violate this AUP, Knowledge Catalyst reserves the right to take immediate action, including but not limited to:
    • Issuing warnings or restricting access.
    • Suspending or terminating accounts.
    • Removing content or data that violates the policy.
    • Reporting violations to legal authorities, particularly when misuse involves health, financial, or trade records.

7.2 Indemnification

  • You agree to indemnify and hold Knowledge Catalyst and its affiliates harmless from any claims, damages, or legal fees arising from your violation of this AUP, the Terms of Use, or applicable laws, including those related to healthcare, trade, or sustainability.

8. Ecosystem-Specific Compliance

8.1 Cross-Border Trade Finance

  • Users processing trade documents, issuing financial guarantees, or performing related activities must ensure compliance with international trade laws, including UCP 600, Incoterms, and any relevant ISO standards.

8.2 Sustainability

  • Users handling sustainability certifications, environmental reports, or carbon credits must comply with global standards for environmental governance, corporate social responsibility, and data privacy.

8.3 Health & Insurance

  • Users in the Health & Insurance ecosystem must ensure that health records and insurance data comply with applicable healthcare regulations, including those governing HealthierSG, SatuSehat, and cross-border healthcare laws. Unauthorized disclosure or misuse of health data will result in legal action.

8.4 Talent Ecosystem

  • Users managing credentials or academic records must ensure compliance with educational and employment laws, including data privacy and anti-discrimination laws applicable to personal credentials.

9. Reporting Violations

If you encounter or suspect any violations of this AUP, please report them immediately to Knowledge Catalyst at policy(at)knowledgecatalyst.io. We will take appropriate action following an investigation of the reported misuse.

10. Changes to this AUP

Knowledge Catalyst reserves the right to amend this AUP at any time. Significant changes will be communicated through the platform or via email. Continued use of the platform after such changes constitutes your acceptance of the updated AUP.

11. Governing Law and Dispute Resolution

This Acceptable Use Policy is governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising in connection with this policy will be subject to the exclusive jurisdiction of the courts of Singapore. However, Knowledge Catalyst reserves the right to take legal action in other jurisdictions if necessary to enforce its rights under this policy or any applicable laws.

11.1. Dispute Resolution Process

  • Before initiating legal action, the parties agree to attempt to resolve any disputes through good-faith negotiations.
